Terms of Service

These Terms of Service (the “Terms”) are an agreement between Maker Labs (“Maker”, “we”, “us”) and the person or entity that creates a Maker account (“you”, “merchant”). By signing up for or using Maker, you agree to these Terms.
1. The service
Maker is a commerce platform that lets you build and run an online store. It includes a merchant back-office (the “Admin”), a customer-facing storefront (the “Storefront”), an AI designer, and related APIs and tools.
2. Your account
You are responsible for keeping your account credentials secure and for every action taken through your account. If you invite staff, you remain responsible for their actions in the Admin. You must be at least 18 years old to create an account.
3. Your content and your store
You own your content — product photos, copy, customer data, and the design of your storefront. You grant Maker a worldwide, non-exclusive license to host, process, and display that content solely as needed to operate the service for you.
You are responsible for the lawfulness of what you sell, for tax registration and collection where required, and for fulfilling your orders.
4. Payments and fees
Maker charges a monthly subscription fee for access to the platform. Transactional payment processing is handled by Stripe under your own connected account; Stripe's processing fees are paid to Stripe, not to Maker. We may also charge usage-based fees that we disclose on your plan page before they apply.
Fees are billed in advance each month. Failed payments may result in reduced functionality and eventually account suspension.
5. Acceptable use
You agree to follow our Acceptable Use Policy. We may suspend or terminate accounts that violate it.
6. Suspension and termination
You can cancel at any time from the Admin. On cancellation, your storefront goes offline. We keep your store data for 30 days so you can reactivate, after which it may be deleted.
We may suspend or terminate your account if you materially breach these Terms, if continued operation would expose us to legal liability, or if your account is used for fraud.
7. Warranties and disclaimers
We work hard to keep Maker reliable, but the service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
8. Limitation of liability
To the maximum extent permitted by law, Maker's total liability in connection with the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
9. Changes to these Terms
We may update these Terms occasionally. When we do, we'll post the revised Terms here and, for material changes, notify you by email or in-app banner at least 30 days before they take effect.
10. Governing law
These Terms are governed by the laws of the State of Delaware, United States. Any dispute will be resolved in the state or federal courts located in that jurisdiction, and you and Maker consent to personal jurisdiction there.
